Defendant shall be punished by a fine of KRW 3,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The Defendant committed the following crimes by opening and using a mobile phone in the name of the victim B.

1. 피고인은 2007. 6. 19. 서울 중구 필동1가 43-1 동화빌딩 1층에 있는 주식회사 굿웰인포텍에서 행사할 목적으로 권한 없이 KTF 이동전화 가입신청서 서식의 이름란에 “B”, 주민등록번호란에 “C”, 주소란에 “서울 구로구 D”, 신청인란에 “B”라고 각 기재하고, B의 이름 옆에 한글로 ‘B’라고 기재하여 권리의무에 관한 사문서인 B 명의의 이동전화 가입신청서 2매(E, F)를 위조하고, 그 즉시 그곳에서 위와 같은 정을 모르는 위 회사 직원 성명불상자에게 이를 제출하여 행사하였다.

2. On June 21, 2007, the Defendant, without authority, forged a copy of the application for joining the mobile phone in the name of B in the above way without authority for the purpose of exercising at G agency located in Seodaemun-gu Seoul (hereinafter referred to as Seodaemun-gu), and immediately submitted it to the above agency, who is unaware of the aforementioned circumstances, and exercised it.

3. As above, even if the Defendant opened and used the mobile phone in the victim’s name, he did not have the intent or ability to pay the said fee, but did not pay the said three mobile phone from around the above time to around September 2007, and did not pay the said fee amount of KRW 2,584,300, thereby allowing the victim to pay it by subrogation.
