1. The facts charged in this case

A. The Defendant was the head of the subordinate branch office of the Foundation D (hereinafter “instant foundation”) from March 2003 to September 2013, 2013.

On November 29, 2006, the Defendant entered into a contract with the H Corporation (hereinafter “instant Corporation”) with the representative E in the name of the instant Foundation, and with the 200,054 square meters of forest land owned by the instant Foundation, to install three land owners (hereinafter “instant Corporation”) with the 550 meters of land owners, and applied for the grant of subsidies to the H Project around December 14, 2006, and received a decision to grant subsidies of KRW 200,000 in total project cost of KRW 200,000,000,000,000,000,000,000,000 won.

Since January 2007, the Defendant: (a) from the victim I, the president of the instant foundation, managed and supervised the said construction on behalf of the victim I; (b) received construction expenses from the victim’s mother J from the Defendant, and requested F to reduce construction expenses; and (c) the victim did not know about the details of construction, such as specific construction cost or self-paid charges, and the progress thereof; and (d) received money as construction expenses and received money as part of the money as construction expenses and received the remainder by the victim.

Around March 2007, the Defendant, at the construction site of this case, requested the F to pay construction expenses continuously for the purpose of construction, such as eckoids, fences, etc., by stating that “When an elementary school located adjacent to the KDawon dry field is closed, it is planned to acquire it from D and make it possible to do the construction work.” From January 2007 to May 2008, the Defendant, who is the president of the instant foundation, requested the payment of construction expenses to the victim of the instant foundation, who is the president of the instant foundation.

However, in fact, the above construction work was completed on July 2007 and there was no additional construction work, and the construction cost was reduced from F to KRW 100 million.
