Examining the reasoning of the lower judgment in light of the evidence duly admitted by the first instance court and the lower court, the lower court is justifiable to have found the Defendant guilty of all the charges of this case except for the portion not guilty on the grounds indicated in its reasoning. In so determining, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence
Other grounds of appeal are asserted by the defendant as grounds of appeal, or by the court below as the subject of judgment ex officio, only for the grounds of appeal, and are not legitimate grounds of appeal.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
