피고인은 2010. 12. 10. 11:00경부터 같은 날 14:20경 사이 울산 동구 전하동에 있는 무지개공원에서, C 등이 윷놀이 도박을 하는 정을 알면서도 판돈을 거둬주고 윷가락을 던져 주는 등의 행위를 함으로써 도박을 방조하였다.
