피고인은 2018. 6. 1. 03:00 경부터 같은 날 03:40 경까지 대구 서구 달 서로 26길 1에 있는 대구 서부 경찰서 평산 지구대 내에 술에 취한 상태로 들어가 별다른 이유 없이 위 지구대에서 근무 중인 경찰관들에게 “ 씨 발 놈 아, 잠 좀 재워도, 미친것들 아”, “ 씨 발 새끼야 날 그냥 두라고” 등의 욕설을 하며 소란을 피우고, 지구대 앞에 주차되어 있는 순찰차량의 창문을 휴대전화로 내려치는 시늉을 하는 등 약 40 분간에 걸쳐 술에 취한 채로 관공서에서 몹시 거친 말과 행동으로 주정하였다.
