Punishment of the crime
[criminal power] On August 31, 2017, the Defendant was sentenced to one year and two months of imprisonment with prison labor at the Incheon District Court for the obstruction of business, etc., and on June 29, 2018, the Defendant completed the execution of the sentence at the Incheon Vocational Training Correctional Institution.
【Criminal Facts】
1. Interference with business;
A. On February 18, 2019, at Jung-gu Incheon Metropolitan City around 21:05, the Defendant: (a) demanded that a customer, who was under the influence of alcohol in the Dnonode room operated by the victim, enter the Dnode room and sing in the said place, “the money would be changed”; (b) provided more than 5,000 won from one customer; (c) however, the Defendant refused to call for the money, but (d) provided that “the money would be increased to singe; (d) the Defendant expressed the desire to call for the payment of the money for 15 minutes.”
Accordingly, the defendant interfered with the victim's musical business by force.
B. On February 20, 2019, the Defendant committed the crime against the victim E at Jung-gu Incheon, Jung-gu, Incheon, stating that “I would like to find out the future,” and “I would like to see why I would not play together,” but it was difficult to avoid disturbance for about 30 minutes due to the following reasons: (a) I would like to say that I would like to say that I would like to say that I would like to see why I would not play together; and (b) I would like to say that I would like to go out of the main place and let customers go out of the main place.
Accordingly, the defendant interfered with the victim's main business by force.
2. On February 20, 2019, the Defendant: (a) around 23:15 on February 20, 2019, at G Ga dan in Jung-gu Incheon, the Defendant: (b) under the influence of alcohol to receive a request from the victim E (nife, 65 years of age) to complete his/her business, demanded a refund while taking the victim’s bath; (c) the Defendant refused it; (d) when the victim refused it, he/she saw the victim’s shoulder on three occasions by drinking on the right side.
Accordingly, the defendant assaulted the victim.
