A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
Based on the facts acknowledged by the evidence duly adopted and investigated by this court, the facts charged were appropriately revised to the extent that it does not infringe the defendant's right to defense.
The Defendant, from September 2018 to September 2019, 2019, was living together with the victim B (n, 48 years of age) and a person who had a relationship with the victim, but came to be hedging due to the difference of character around September 2019.
The victim was in the state of requesting the police to protect the victim on September 9, 2019, because the victim made verbal abuse by the defendant again, or caused suicide.
1. Intimidation;
A. On October 5, 2019, the Defendant, from around 18:36, 2019 to the victim from around October 5, 2019, called, “Around 19:00 on the same day, the Defendant found the victim as the main points in the operation of the victim located in Eunpyeong-gu Seoul Metropolitan Government C, and provided, “Absing the victim with the store operated. I do not see how you do not do so. I may die.”
After the Defendant continued to enjoy 112 personal protective devices for reporting the victim, the Defendant threatened the victim by stating that “I will turn on her cell phone immediately after she left the said 112 protective devices for reporting. I will not look back next to her. I would like to do so. I would like to do so. I would like to do so. I would be responsible for all of the internal actions. I would be able to look at the facts of living with the width. I would be able to bring about to the surrounding people.”
B. On October 6, 2019, the Defendant committed fire in the victim’s residence, as set forth in paragraph (3), and on October 6, 2019, the following day: (a) on October 6, 2019, the Defendant: (b) destroyed the victim’s cell phone from the building in Jung-gu Seoul, Jung-gu; and (c) died in the son’s hand; and (b) died in the son’s hand; and (c) died in the son’s seat; (d) the thoth shall be used to kill the son; (e) the son’s thoth shall be hidden; and (e) the son’s personal ties will come to the victim.”
