A. On June 17, 2012, the Plaintiff entered the Republic of Korea with a short-term visit (C-3, and 30 days of stay), and applied for refugee status to the Defendant on July 16, 2012.

B. On April 7, 2014, the Defendant rendered a disposition of non-recognition of refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would suffer persecution” as a refugee requirement under Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol Relating to the Status of Refugees.

2. Whether the instant disposition is lawful

가. 원고의 주장 원고는 이그보(Igbo)족 출신으로 이그보족의 옛 국가인 비아프라(Biafra) 분리 독립 운동 조직인 마솝(MASSOB)에 가담하였다.

2011년 대규모 시위에서 마솝의 수장 B가 체포되었고, 원고는 청년 지도자로서 경찰에 체포된 간부 조직원의 석방을 요구하는 시위를 주도하는 등 비아프라의 독립을 위해 대규모 시위를 이끌며 왕성한 활동을 하였다.
