1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
Plaintiff’s assertion
On February 22, 2014, the Defendant suffered damage from water leakage occurring in the Plaintiff’s house, one’s house, and caused the Plaintiff’s entrance door to damage the Plaintiff’s string and verbal abuse. On the same day from 09:00 to 12:00, the apartment management office had the Plaintiff take measures to cut off the Plaintiff’s house. Accordingly, the Plaintiff was used for the hospital and was hospitalized in the hospital on February 25, 2014.
In addition, the date of discharge as seen above, the Plaintiff re-hospitalized the Defendant, after hearing abusive and verbal abuse, and discharged the hospital on March 3, 2014. Since then, on March 5, 2014, the Plaintiff was hospitalized in the hospital and discharged the hospital on the following day.
As above, the Defendant committed tort, such as fractional, damage to property, abusive language, etc., and thus, is obligated to pay damages to the Plaintiff KRW 24.5 million (=175 million x 14 months), which is a part of KRW 19.4 million among the damages for 14 months from February 22, 2014 to April 21, 2015 (i.e., KRW 17.5 million x 14 months) and KRW 600,000,000, which is a part of KRW 603,863 of medical expenses, and KRW 10,000,000 and KRW 30,000,000,000 and damages for delay.
Judgment
First, according to each description and image of Gap's evidence Nos. 1 through 8, 11, 14 through 20, and Eul evidence Nos. 1 and 2 (including household numbers; hereinafter the same shall apply), the defendant's wife C filed a lawsuit against the plaintiff residing on the upper floor against the plaintiff living on the upper floor under this court No. 2014 Ghana1074, and was sentenced to some winning judgment. The appellate court continued to be the Daegu District Court No. 2014Na20132, the plaintiff was transferred from home to D hospital on February 22, 2014, and the plaintiff was transferred from D hospital on March 3, 2014 to D hospital again on the date of discharge, and the plaintiff was released from D hospital on March 3, 2014 to D hospital on March 3, 2014, and the plaintiff was released from D hospital on March 4, 2014, and was released from D hospital on March 31, 2014.
