Punishment of the crime

"2017 Highest 2134"

1. On June 25, 2017, the defrauded Co., Ltd.: (a) visited the site called “a item unit unit” through a mobile phone at the Defendant’s residence located in Bupyeong-si D around December 25, 2017; and (b) sold an account of KRW 20 billion in the so-called online game item.

“ ..............” posted a notice of the content.

However, the defendant did not have the above account, so even if he received the sale proceeds, he did not have the intention or ability to sell the above account.

Nevertheless, the Defendant made a false statement to the victim C who reported and contacted the above notice on the same day, and received 170,000 won from the victim’s account in his/her name, as if he/she sold the above account.

2. On July 26, 2017, the criminal defendant against the victim F was connected to the site called “a item unit unit” through a mobile phone at the defendant’s residence, such as the foregoing paragraph 1, around July 26, 2017, and sold an account of 20 billion won in the PP online 3 game item.

“ ..............” posted a notice of the content.

However, the defendant did not have the above account, so even if he received the sale proceeds, he did not have the intention or ability to sell the above account.

Nevertheless, the Defendant made a false statement to the victim F, who reported and contacted the above notice on the same day, and received 1.40,000 won from the victim’s account in his/her name, as if he/she sold the above account.

Accordingly, the defendant deceivings the victims and received property from the victims as sales proceeds.

1. No person who violates the telecommunications business Act shall intermediate a third party's communications through telecommunications services provided by the telecommunications business operator, or provide it for any third party's communications;

Nevertheless, on March 2016, the defendant receives 300,000 won from a person who was not injured by his name.
