1. 피고인 A 피고인 A는 2011. 5. 1.경 G의 ID ‘H’인 회원이 ‘KBS’에서 저작권을 가지고 있는 ‘백점만점 전국아이돌체전’ 영상파일을 저작권자의 허락없이 복제하여 G 사이트에 게재한다는 점을 잘 알면서도, 사이트에 게재된 저작물의 고유 DNA 내지 해쉬값을 추출하여 제휴저작물과 대조ㆍ분석한 뒤 불법저작물을 손쉽게 삭제할 수 있는 필터링 프로그램을 구동하지 않거나, 금칙어로 지정되어 있더라도 특수문자인 ‘*, !, #, $, %, ^’와 결합하면 우회적으로 검색이 가능하도록 하는 등 형식적으로 금칙어를 설정하고, 저작권자들의 요청이 있을 경우에만 해당파일을 삭제하는 등의 방법으로 불법저작물을 방치하여, 불특정 다수의 사이트 이용자들로 하여금 대금(포인트)을 지급하고 위 저작물을 언제든지 쉽게 내려받을 수 있도록 하여 저작권자들의 저작물에 대한 복제, 공중송신, 배포를 용이하게 하였다.
