1. 피고인 A 피고인은 2013. 6. 21. 03:00경 제천시 C에 있는 ‘D’ 술집에서 피해자 E(여, 18세), 피해자 F(여, 18세)와 함께 술을 마시던 중 피해자 E에게 “이름이 뭐냐, 손이 이쁘다, 나는 노가다를 해서 손이 못 생겼다, 내 손을 좀 봐라”라고 말을 하면서 강제로 위 E의 손을 잡고 주무르고, 위 E의 어깨에 손을 올려놓아 옆으로 비키자 다시 다가와 “왜 이러냐, 딸 같아서 그러니, 기분 좋게 술을 마시자”라고 말하며 위 E의 어깨에 손을 올리고 허리를 감싸 안고, 계속하여 자리를 옮겨 피해자 F에게 다가가 “오빠라고 불러라, 학교는 다니냐, 집은 어디냐, 몇 년 생이냐, 둘이 친구냐”고 말하며 위 F의 허벅지를 만지고 다시 귓불을 만지고, 같은 날 04:00경 제천시 C에 있는 G노래방에서 피해자 F이 노래를 부르자 그 뒤에서 위 F을 안고 손으로 위 F의 가슴을 주무르는 등 피해자들을 강제로 추행하였다.
