1. The defendant shall be the plaintiff.

(a) Of the real estate listed in the separate sheet, the Attached Form No. 26, 18, 19, 20, 21, 25, and 26 shall apply.

Reasons

1. Basic facts

A. The Plaintiff is the owner of the real estate indicated in the attached list (hereinafter “instant land No. 1”). The Defendant is the owner of the land adjacent to the instant land, Osan-si, 802 square meters adjacent to the instant land (hereinafter “instant land No. 2”) and the owner of the building on its ground.

나. 피고는 이 사건 제 1 토지 중 별지 도면 표시 26, 18, 19, 20, 21, 25, 26의 각 점을 순차로 연결한 선내 ( ㄴ) 부분 14㎡[ 이하 ‘( ㄴ) 부분’ 이라 한다] 의 시설물( 담장, 아스팔트 포장) 을 점유하고 있고, 별지 도면 표시 24, 21의 각 점을 연결한 시설물( 담장 )에 있는 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ의 각 우수관( 이하 ‘ 이 사건 우수관’ 이라 한다) 을 설치하였는데, 별지 도면 표시 24, 21의 각 점을 연결한 시설물( 담장) 을 기준으로 이 사건 제 2 토지가 이 사건 제 1 토지보다 높게 조성되어 있으며, 이 사건 우수관은 이 사건 제 1 토지 방향으로 우수가 흘러 나 오도록 설치되어 있다.

2. Determination

A. According to the above facts of recognition as to the cause of the claim, since the part (b) possessed by the defendant is installed on the land of this case, which is owned by the plaintiff, is owned by the plaintiff, the defendant is obligated to remove and deliver (b) the part to the plaintiff.
