1. Basic facts

A. The Plaintiff’s wife 1) The Plaintiff’s wife 3 floors among the 3th floor of the Gwangju Dong-gu District Building from F on March 15, 2006 (hereinafter “instant building”).

(2) The Plaintiff and C have leased the instant building on May 1, 1985, and the purpose of use on the building ledger is a store. (2) The Plaintiff and C have changed the use of part of the instant building into a studio, and sub-leased it. However, the Plaintiff did not obtain permission from the competent authorities or report it to the competent authorities.

3) On January 27, 2011, C registered its business with G and place of business as the instant building, type of business, and real estate sub-lease business; and C died on October 3, 2013; and the Plaintiff is the heir of C.

(b) Project name and public notice 1): Three primary projects for construction of new roads (hereinafter referred to as the “instant project”) in Gwangju Urban Planning Facility Project D.

(ii) Public announcement of project approval: The project operator E published by the Dong-gu Gwangju Metropolitan City on November 24, 201; the head of Dong-gu Gwangju Metropolitan City on November 24, 201

C. Plaintiff’s claim for adjudication and related litigation 1) The Plaintiff claimed to the head of Gwangju Metropolitan City Dong-gu for adjudication by urging the Plaintiff to compensate for losses incurred by the Plaintiff in relation to the business operated in the instant building, but on June 3, 2014, the head of Gwangju Metropolitan City Dong-gu rendered a disposition rejecting the Plaintiff’s claim for adjudication on the ground that the Plaintiff is not a person eligible for compensation for losses and is not a person eligible for compensation. (2) The Plaintiff filed a lawsuit seeking revocation of the above disposition against the head of Gwangju Metropolitan City Dong-gu, Gwangju Metropolitan City around 2014Guhap1048, and sought reimbursement of KRW 14,540,00 for operating losses against the Defendant.

3. On September 24, 2015, the Gwangju District Court suffered loss to the plaintiff as the project of this case, and the loss is the object of compensation.
