1. The Defendant’s reprimand disposition against the Plaintiff on May 16, 2016 shall be revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. On April 1, 1998, the Plaintiff was appointed as YY and transferred to C middle school teachers on March 1, 2014. From March 1, 2015 to February 29, 2016, the Plaintiff was temporarily retired from office under Article 71 subparagraph 6 of the State Public Officials Act (hereinafter referred to as “full-time school assistant”) and was in office as Cmiddle school teachers on March 1, 2016.

On June 13, 2016, the Plaintiff filed a petition review with the Defendant seeking revocation of the instant disposition, but was dismissed on August 18, 2016.

2. Whether the instant disposition is lawful
A. The Plaintiff’s assertion 1 “collective act for purposes other than public service” prohibited by the State Public Officials Act refers to a collective act that may affect the duty of care for the purpose of going against the public interest.
The assembly and demonstration of this case pointed out the problem of nationalization of Korean private textbooks.
