A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (one philophone, hereinafter “philophones”) and marijuana as follows:

1. From September 13, 2019 to October 11, 2019, the Defendant purchased phiphones from B around September 13, 2019, the Defendant transferred KRW 500,000 to a bank account (Account Number: G) in the name of the F designated by B (E) bank located in Yang-gu, Gangwon-do D Bank C, and purchased phiphones by means of finding approximately 1g of the phiphones that the said B concealed in advance at the boundary of the fixed and closed area of the mutual insular rest located in Pyeongtaek-gu, Gyeonggi-do around the same day.

The Defendant purchased 5.5g in total from B to October 11, 2019 the sum of 5.5gs from B to 2.950,000 won, respectively, on five occasions, as shown in the list of crimes committed in the attached Table.

2. 2019. 11. 11.경 필로폰 매매알선 피고인은 텔레그램을 이용한 필로폰 판매자 H(텔레그램 ID 불상)으로부터 필로폰 매수자를 소개해 달라는 부탁을 받고, 2019. 11. 11. 17:17경 스마트폰 어플 즐톡을 통해 알게 된 성명불상자에게 H이 지정한 I 명의의 D은행 계좌(계좌번호 : J)를 알려주어 대금 30만 원을 송금하도록 한 후 위 성명불상자로부터 대금을 입금한 영수증 사진을 전송받아 이를 H에게 전달해주고, 위 성명불상자에게 H의 텔레그램 ID를 알려주어 H과 직접 연락한 후 필로폰을 찾아갈 수 있도록 하였다.

As a result, the Defendant mediated the purchase and sale of phiphones between H and a person with no name.

3. Around November 15, 2019, the Defendant purchased 1g of philopon from H in a numberless car operated by H in front of the K agency located in a place below Ulsan, around 13:00 on November 15, 2019.
