A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around August 15, 2012, the Defendant threatened the victim C with an attitude of drinking at E cafeteria located in Jung-gu Seoul, Jung-gu, Seoul on August 15, 2012, and around 15:00 of the same day to the victim C (52 years of age) who is an employee of the above cafeteria, and threatened the victim by voice “this spaws, spaws, and spats.”
2. Around August 15, 2012, the Defendant assaulted the Victim F with the victim F, who was an employee of the said restaurant, with the victim F (the 55-year-old age), with the intent of “pump sule sule” and sulbling sule, etc. immediately after the victim threatened C, such as the above E restaurant, as described in paragraph (1).
3. On August 15, 2012, the Defendant, at around 18:10, charged the Defendant with the charge of interfering with the above restaurant business for about 20 minutes from August 15, 2012 to 40 minutes, on the ground that the said restaurant was stored in the above E restaurant and the sound of the outdoor flag was damaged, as indicated in paragraphs 1 and 2 of the holding, and by force, the Defendant was charged with the Defendant’s interference with the above restaurant business for about 20 minutes from August 15, 2012 to 40 minutes. However, according to the evidence stated in the summary of the evidence below, only the above facts are recognized.

4. 피해자 H에 대한 폭행 피고인은 2012. 8. 15. 18:40경 서울 중구 I에 있는 J에서 피해자 H(61세)가 피고인의 위와 같은 업무방해 및 폭행 등 광경을 쳐다봤다는 이유로 “뭘 봐 이 새끼야, 너 죽여 버린다”, “E 여자가 니 마누라냐”고 소리치면서 피해자에게 달려들어 피해자의 낭심 부위를 향해 주먹을 휘두르고, 2012. 8. 16. 09:00경 위 J로 다시 찾아가 피해자에게 “죽인다”고 소리치면서 손으로 피해자의 멱살을 잡아 목을 누르고 바지 허리춤을 잡아 흔드는 등 폭행하였다.
5. The Defendant, around 14:00 on September 19, 2012, at L parking lot located in Jung-gu Seoul, Jung-gu, Seoul, to the victim F, “I am at the time. I am am at the time,” to the victim F.
