A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 171"

1. The Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Commercial Sex Acts, Etc.) operated a marina business with the trade name “C” from around April 30, 2018 to February 27, 2019, while employing a female with the nationality of the Thailand each time when the female engages in commercial sex acts, thereby receiving 100,000 won from the customer and paying 40,000 won out of the amount to the female commercial sex acts.

Accordingly, around July 23, 2018, the Defendant: (a) around 13, 2018, ordered a female with the nationality of Thailand to receive 100,000 won per conference from customers, and 1.3 million won per day from customers; and (b) transferred 520,000 won among them to sexual traffic women; (c) from around 89 times to October 2018, the Defendant paid 3.6 million won among them to the female with sexual traffic; (d) from February 14, 2019 to February 27, 2019 to receive 10,000 won per day from the female with sexual traffic; and (e) paid 40,000 won to the female among them.

Accordingly, the defendant committed commercial sex acts such as arranging commercial sex acts.

2. No person who violates the Immigration Control Act shall employ any foreigner who has no status of sojourn eligible for employment activities;

Nevertheless, from April 30, 2018 to October 10, 2018, the Defendant employed D, a foreigner of the nationality of Thailand, who entered the Republic of Korea from October 9, 2018 to October 10, 2018, as a marina branch where he/she concurrently engages in sexual traffic at the said establishment, from October 3, 2018 to October 10, 2018.

Any person of "2019 Highest 448" shall be eligible for sojourn status that makes it possible to engage in job-seeking activities.
