A defendant shall be punished by imprisonment for six months.

The defendant shall obtain money by deceit and consolation money of 500,000 won from B who is an applicant for compensation.

Punishment of the crime

On October 6, 2011, the Defendant was sentenced to one year of imprisonment for fraud at the Busan District Court, and on March 30, 2012, the parole period expired on May 4, 2012.

1. On January 30, 2014, the Defendant of the instant case No. 2014Kadan230, the first instance court, on the one hand, sent a false statement to the victim D, who called “I am 5,000 won,” stating that “I am 5,000 won will be sold at 350,000 won” on the Internet NAV website, without any intention or ability to sell the goods. The Defendant, on the other hand, received money from the victim to the new bank account in the name of the Defendant.

In addition, from around that time to February 5, 2014, the Defendant received a total of KRW 1,700,000 from the victims five times in total as shown in attached Table 1.

2. On September 4, 2014, the Defendant: (a) posted a letter stating that “galthot3 is sold” on the said Gona website without any intent or capacity to sell the goods; (b) deceiving the victim B by deceiving the victim; and (c) acquired KRW 350,000 from the victim to the Agricultural Cooperative Account in the name of E on September 1, 2014.

In addition, the Defendant received money of KRW 1,420,00 from the victims five times in total, as shown in attached Table 2. From around that time to the 13th day of the same month, and acquired it by fraud.

3. The Defendant, around August 29, 2014, posted a letter stating that “The Dop PC is sold” on the above Jungna website, without any intent or capacity to sell the goods, by deceiving the victim H, thereby deceiving the victim H to transfer KRW 250,000 from the victim to the NA bank account in the name of E, and acquired it by deception.

In addition, the Defendant from around that time to September 3, 2014.
