A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 폭행 피고인은 2019. 10. 26. 22:25경 용인시 기흥구 B 소재 C 부근을 지나가는 객차 안에서, 술에 취해 위 객차에 탑승하여 마침 D에 갔다가 집으로 가기 위해 그곳에 서서 탑승하고 있던 승객인 피해자 E(남, 13세)을 발견하고 다가가 “너 원숭이 닮았네, 너 어디 사냐 학교가 어디냐 네가 짱이냐 ”라고 하면서 시비를 걸면서 손가락으로 피해자 E의 배 부위를 수회 찌른 다음 무릎으로 위 E의 엉덩이 부위를 4회 차고, 위 E의 옆에 서 있던 일행인 피해자 F(남, 14세)에게 다가가 “네가 짱이냐”라고 하면서 손으로 피해자 F의 손목과 팔을 만진 다음 손가락으로 피해자 F의 배 부위를 수회 찌르고, 계속하여 위 E과 F의 옆에 있던 일행인 G으로부터 제지를 받자 아래 제2항 기재와 같이 G의 가슴과 엉덩이 등 신체를 만져 추행하여 이를 본 다른 승객인 피해자 H(남, 15세)로부터 “술을 마시고 뭐하시는 짓이에요”라고 하면서 제지를 받자 화가 나 손으로 피해자 H의 오른 뺨을 1회 때리고 머리채를 잡아 수회 눌러 피해자들을 각 폭행하였다.
