Punishment of the crime

1. "2019 Highest 1068";

(a) No one shall arrange sexual traffic in violation of the Punishment of Arrangement of Commercial Sex Acts, etc.;

Nevertheless, at around 20:30 on February 22, 2019, the Defendant: (a) received 130,000 won from the customer who visited the said business establishment; and (b) assisted the said customer to engage in sexual intercourse, by allowing the said customer to engage in sexual intercourse with the third party’s nationality (the age of 27) in which the Defendant employed.

(b) No person who violates the Immigration Control Act shall employ any foreigner who has no status of sojourn eligible for employment activities;

Nevertheless, from February 21, 2019 to February 22, 2019, the Defendant employed as an employee the E, F, and G of the Thailand nationality, who did not have the status of stay to engage in job-seeking activities at the place specified in paragraph (1).

2. From May 18, 2018 to August 7, 2019, the Defendant operated “I” entertainment bars on the Ha and the 5th floor of Pyeongtaek-si from around May 18, 2018, and received 190,000 won per head, including the price for commercial sex acts, liquor, from customers who found the said business place, and had commercial sex women drink and sing with customers in the room of the said business place, and had them do sexual intercourse at the room or the neighboring telecom.

Accordingly, the defendant committed acts of arranging sexual traffic for business purposes.
