피고인은 2013. 5. 7. 15:20경부터 15:30경까지 사이에 경기 고양시 일산동구에 있는 강선마을 버스정류장에서 C 버스(일산동구청 방면부터 파주 교하읍 방면으로 진행)에 탑승하여 내리는 문 뒤편 창가 좌석에서 졸고 있던 피해자 D(여, 19세)을 발견하고 피해자의 옆에 앉아 팔짱을 낀 상태로 왼손으로 피해자의 왼쪽 가슴 부분을 피해자가 입고 있던 남방 위로 주무르고, 계속하여 피해자가 입고 있던 남방을 옆으로 젖히고 그 안에 있던 티셔츠 위로 피해자의 왼쪽 가슴 부분을 주무르는 등 피해자를 강제로 추행하였다.
