A defendant shall be punished by imprisonment for not less than five months.

Punishment of the crime

The Defendant, at the Gwangju District Court on May 11, 2016, sentenced four months of imprisonment with prison labor for the crime of interference with business, and on August 25, 2016, sentenced five months of imprisonment with prison labor for the crime of violation of the Act on Promotion of Information and Communications Network Utilization and Communications Network Utilization and Information Protection, etc., and completed the execution of the sentence in the Ganpo

The written indictment contains that the execution of punishment was completed on September 12, 2016, but according to the investigation report (verification of the fact of release related to repeated crime) (Evidence No. 22), it can be recognized that the execution of punishment was completed on September 19, 2016.

As above, there is no substantial disadvantage in exercising the defendant's right of defense.

피고인은 피해자 J(여, 52세)이 운영하는 ‘K’에서 근로하였던 사람으로, 피해자가 피고인의 근무시간을 임의로 조정하고 반말을 하는 등 부당하게 대우하였다는 이유로 불만을 품고 2018. 11. 2. 16:23경 광주 동구 L에 설치된 공중전화를 이용하여 피해자의 휴대전화로 전화하여 피해자에게 “주둥이를 도끼로 콱 찍어버려 개 같은 년이 야 사람이 우습게 보이냐.”라고 말하고, 같은 날 16:29경 위와 같은 방법으로 피해자에게 “이 씨발년 아가리 칼로 콱 쑤셔버릴라니까.”, “내가 신고 한 번 해줄게. 너 가게 앞에서 하는 게 불법인지 합법인지 내가 알려줄게. 그것도 불법이여.”라고 말하고, 같은 날 16:31경 위와 같은 방법으로 피해자에게 “그것도 가게라고, 이 씨발년아. 그것도 불법이야. 엉 알려줄까 신고할게. 기다려. 기다려.”, “이 씨발년아, 좆같은 년아. 엉 아가리를 목구멍에다 칼을 콱 쑤셔 박아버릴라니까.”, “이 씨발년아, 개 호로쌍년아. 보지를 콱 찢어버릴라니까, 개같은 년을.”이라고 말하고, 같은 날 16:33경 위와 같은 방법으로 피해자에게 “그것도 불법이여, 이년아.”, “엉. 알려줘 봐야겠네. 신고 좀 당해봐야 알겠네.”라고...
