The defendant is the representative of "C", which is a controlled entity, and is one owner of buildings located in D and one parcel in Busan Jung-gu, Busan, and a person who has concluded a contract for the entrustment of building management with E as an agent.

On June 29, 201, the above building entered into a lease agreement with lessee G on June 29, 201, but as the ownership of the building was divided on December 29, 201, the Defendant decided to forge the lease agreement, unlike the lease agreement already made in order not to extend the contract period.

1. Around January 10, 2012, the Defendant forged private document: (a) stated in the form of a building lease agreement that “the two-story store (living facilities located in Busan Jung-gu D and 1) with 130.94 square meters (39.60 square meters) located in the 4th floor of reinforced concrete building located in Busan Jung-gu, and 1, and 36 months from January 1, 2012 to December 31, 2014, shall be KRW 4,167,000 on a monthly rent without a deposit for 36 months; and (b) stated in the column of the contract that “name: E (I), address: H, 5th floor, contact address: Ha-gu Busan Metropolitan City, and lessee’s name and address: The name and address of the tenant in advance, and the name and address of the tenant in G: G: the name and address of the tenant in advance.”

Accordingly, for the purpose of exercising, the Defendant forged one copy of the building lease contract in G name, which is a private document on rights and obligations.

2. On July 1, 2014, the Defendant: (a) filed a lawsuit for the request for the delivery of a building at the Busan District Court’s public service center located in Busan District Court, which was located in the Busan District Court; (b) and (c) filed a lawsuit against G; and (d) delivered a copy of the forged building lease contract as if it was a document duly formed by a defense counsel to employees who are not aware of the fact.
