A. On November 2, 2017, the Plaintiff and the Defendant concluded a broadcast contribution agreement to exclusively contribute to personal broadcasting services operated by the Plaintiff (hereinafter “instant agreement”).

B. The main contents of the instant contract are as follows (the Plaintiff “A”, “B” refers to the Defendant), and the Plaintiff paid the Defendant the down payment amount of KRW 20,000,000 in accordance with Article 3 of the instant contract on November 2, 2017.

The Broadcasting Contribution Agreement A (hereinafter referred to as the "A") and B (hereinafter referred to as the "B") shall enter into a contract with the "B" to contribute exclusively to the domestic and overseas Internet broadcasting operated by the "A" or designated by the "A" as follows:

제3조(계약금 및 계약금 지급시기) ㄱ) 계약금: 일금 사천만 원(40,000,000원) - 원천세 공제 후 지급 ㄴ) 지급시기: 1차 계약서 날인(약속어음 공증) 후 일금 이천만 원(20,000,000원) 지급 2차 “을”의 팬 3만명(즐겨찾기 등록한 회원) 확보 후 입금 이천만 원 (20,000,000원) 지급 제4조(계약금 지급조건) ㄱ) 계약기간: 2017년 11월 2일부터 2019년 11월 1일까지 24개월로 한다. ㄴ) 월 방송횟수: 20회(1일 1회 방송을 원칙으로 한다). ㄷ) 1일 방송시간: 1회 연속 4시간 이상 방송이 진행되어야만 1회 방송 완료로 인정함. ㄹ) 방송요일 및 요일별 방송시작 시간: 평일(화요일에서 금요일, 8시부터) 주말(토요일, 8시부터) ㅈ) 월 방송일수 미준수 페널티: 월 방송일수 미준수 1회마다 300,000원씩 배상(단, 익 월에 미준수 방송횟수를 완료하면 페널티 금액 면제됨). 미준수 방송횟수의 페널티금 액은 정산금에서 제외하거나 계약종료일 또는 계약해지일에 일괄 계산한다. ㅍ) 실 계약기간은 첫 방송일로부터 24개월로 하며 본 4조 내용이 모두 완료되어야만 계약의 종료로 인정한다.
