1. 모욕 피고인은 2017. 11. 17. 05:15 경 부산 사하구 C에 있는 B( 여, 61세) 이 근무하는 D 식당에서, B로부터 담배를 피우지 말라는 제지를 받자 다른 종업원과 손님들이 듣고 있는 가운데 B에게 큰소리로 소리쳐 공연히 B을 모욕하였다는 이유로 112 신고를 받고 출동한 부산 사 하경 찰 서 E 지구대 소속 경찰 관인 피해자 경위 F(52 세 )로부터 욕설을 그만 할 것을 요구 받자 손님과 식당 종업원들이 듣고 있는 가운데 피해자에게 “야 이, 씹새끼야, 좃 같은 놈 아, 왜 왔는데 ”라고 큰 소리로 소리쳐 공연히 피해자를 모욕하였다.

2. 업무 방해 피고인은 2017. 11. 17. 05:00 경부터 같은 날 05:25 경까지 부산 사하구 C에 있는 피해자 B( 여, 61세) 이 근무하는 D 식당에서, “야 이, 씨발 년 아, 개 같은 년 아, 씨발 년 아, 개 좃 같은 년 아, 배 떼 지를 칼로 찔러 쥑이 삘까, 씨발 년 아 강간을 했삘 까 ”라고 큰 소리로 욕설을 하며 소란을 피워 다른 손님들이 들어오지 못하게 하는 등 위력으로 피해자의 식당 영업 업무를 방해하였다.
