1. The Plaintiff:
A. Defendant C shall complete the payment of KRW 89,107,826 and KRW 88,609,889 among them from April 28, 2020.
According to the statements in Gap evidence Nos. 1, 4 through 8, and 10 (including additional numbers), it is recognized that the plaintiff extended a loan to defendant C on September 14, 2017 at the interest rate of 11.9% per annum, interest rate of 14.9% per annum, interest rate of 60% per annum, interest rate of 60 months per annum, and interest rate of 182 million won per repayment method, and the defendant D guaranteed the above debt of defendant C within the limit of 182 million won per annum. However, the defendants lost due interest due to delay in the repayment of principal and interest, and as of April 27, 2020, the principal and interest rate of 88,609,889 won, interest rate of 497,937 won per annum, total of 89,107,826 won has not been repaid.
Therefore, Defendant C is obligated to pay the Plaintiff damages for delay calculated at the rate of 14.9% per annum from April 28, 2020 to the date of full payment. Defendant C is jointly and severally liable with Defendant C to pay the Plaintiff the said money within the limit of 182 million won.
Thus, the plaintiff's claim against the defendants is justified, and this is accepted.
