A is the person who operates the “U” of a credit service company, and Defendant B is the person who operates the “V” of a credit service company, and Defendant C, D, E, G, H, I, J, J, K, L, M, N,O, and P are the former owners of the nominal bond market.
Where a credit service provider lends a loan to an individual, the interest rate shall not exceed 44% per annum.
Nevertheless, around November 6, 2010, Defendant A agreed to the effect that “I will lend KRW 7,700,000,000 on the security of 5,170,000 shares of W” and “I will lend 7,700,000 won on the condition of 8.5% prior to each month,” and around that time, Defendant B requested Defendant B to “I would obtain the said money on the condition that I would receive 1-month interest and 6% of the above shares as security,” and Defendant B offered to all owners, such as Defendant C, D, E, G, H, I, H, H, K, K, N,O, P, and then offered to Defendant B, who had been engaged in usual transactions, “I would request to raise funds on the condition that I would receive 1-month interest and 5% of the total amount as security, as shown in attached Table 7,700,000 won in order from each previous share, and offered to Y during the foregoing period of investment.”
