[2013고단651] 피고인들은 D와 공동하여 2012. 12. 14. 01:30경 익산시 E에 있는 F주유소 사거리 노상에서 그곳에 신호대기 중인 택시 뒷좌석에 승차하여 있던 피해자 G(31세)이 위 택시 옆에 정차한 로체 차량에 타고 있던 피고인들 일행을 향해 욕설을 하였다는 이유로 시비가 되어, D는 위 로체 차량에서 내려 위 택시 뒷좌석에 승차하고 있던 피해자를 끌어내 "뭘 꼬라 보냐."라고 하면서 주먹으로 피해자의 머리 부위를 5회가량 때리고 얼굴 부위에 침을 2회가량 뱉고, 피고인 A은 피해자의 얼굴 부위에 침을 2회가량 뱉고, 피고인 B는 옆에 서서 피해자에게 "이런 병신 새끼."라고 욕설을 하면서 위세를 가하였다.

[2013고단862] 피고인 A은 2012. 6. 23. 04:30경 익산시 H에 있는 I주점에서 친구인 J, D, K, L, M 등과 같이 술을 마시던 중, J, D가 피고인 등 위 친구들과 함께 잠을 잘 모텔을 정하고 다시 위 주점으로 운전해 오다가 피해자 N(33세)를 보고 경음기를 울렸으나 피해자가 길을 비켜주지 않으며 경음기를 울린 것에 대해 항의를 하는 것에 화가 나 J은 피해자에게 욕설을 하며 발을 걸어 넘어뜨린 다음 발로 피해자를 수 회 짓밟고, D는 피해자에게 욕설을 하며 발로 피해자를 걷어찼다.
