The Defendant filed a lawsuit against the Plaintiff as Seoul Central District Court 2009 Ghana2572370 and filed a lawsuit seeking the payment of the acquisition amount with the Defendant, and “the Plaintiff shall pay 8,831,474 won and 3,699,984 won with the interest of 20% per annum from June 17, 2009 to the date of full payment” (hereinafter “instant judgment”). The judgment of this case becomes final and conclusive after the judgment of this case becomes final and conclusive; the Plaintiff filed an application for bankruptcy and exemption under the Daegu District Court 2017Hau District Court 2017Hau1046 and 2017, and the said court rendered a decision of immunity against the Plaintiff on September 22, 2017; the fact that the above decision of immunity became final and conclusive on October 11, 2017 does not conflict between the parties, or is recognized by evidence Nos. 1, 2, 35-2, and 5-3.
According to the above facts of recognition, according to the above immunity decision, the Plaintiff’s obligation to take over the Defendant was exempted.
Compulsory execution based on the judgment of this case shall not be permitted.
The plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
