A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is a person engaged in the wholesale and retail business of mobile devices, B is the defendant's wife, C is the defendant's mother, and D is the head of the defendant.
1. The Defendant, without authority, attempted to forge a contract for acquisition of shares in the name of E and D without acquiring all shares in the name of C and in-house directors of F Co., Ltd., a shareholder of E Co., Ltd., by acquiring all shares in the name of C and in-house directors of F Co., Ltd., a shareholder of E Co., Ltd., and exercising rights to change directors of the said company.
On November 20, 2015, the Defendant entered into a contract for acquisition of shares in blank with Dworkd professional document and verification-type pen at H office located in Seogu-gu, Daegu-gu, Seoul-gu, with the following:
The purpose of this contract is to take over the shares of E Co., Ltd. owned by E Co., Ltd. (seller). The issuing company: E Co., Ltd., the number of acquired shares: 10,000 O, the total acquisition value of KRW 10,000,000 (Won 50,000,000), and the date of stock transfer: December 1, 2015, and the seller’s name, resident registration number, address, and contact information of E Co., Ltd. are stated in the seller’s column, and then, the above C’s seal imprint under the name of E Co., Ltd was affixed to the name of E Co., Ltd.
In addition, the Defendant, at the same time, at the same place, and in the same manner, enter into a contract for acquisition of shares as follows:
The purpose of this Agreement is to take over the shares of F Co., Ltd. owned by the seller A (the seller). The issuing company is F Co., Ltd. and the number of acquired shares: 10,000 O,00 won share certificates, 10,000 won (Won 50,000,000), and 1 December 2015, the date of stock transfer: : (A) the seller’s name, resident registration number, address, and contact details are stated in the seller’s column, and (b) the above D’s name, resident registration number, address, and contact details are stated in the company’s computer equipment rental contract.
