피고인은 2018. 12. 26. 22:30경 수원시 권선구 B에 있는 C주점에서 그곳 업주인 피해자 D(여, 48세)와 합석하여 술을 마시던 중 손님들이 모두 나가고 피해자가 화장실에 간다며 자리를 비우자 수면유도 성분이 포함된 약을 피해자에게 몰래 먹여 정신을 잃게 하기로 마음먹고, 간질 및 공황장애 치료제이자 향정신성 의약품으로서 호흡기계 및 심혈관계 진정작용을 가진 클로나제팜 성분이 포함된 불상의 알약을 라이터로 부수어 가루로 만든 뒤 피해자의 맥주잔에 타 피해자로 하여금 마시게 하려고 하였으나, 잔에 담긴 술의 색깔이 달라진 것을 알아챈 피해자가 마시기를 거부하는 바람에 그 뜻을 이루지 못하였다.
