The defendant is innocent. The summary of this judgment shall be notified publicly.
1. On March 10, 2017, the Defendant: (a) driven a Bchip car on March 17, 2017, and got to turn to the left at the right edge of the Pungsan mountain through the aforesaid intersection while driving a four-lane road in front of the shooting distance of the Center for Fishery Products in the Pungsan-dong, Seoyang-gu, Seoyang-si; and (b) driving along two-lanes from the shooting distance of the relative hospital in that country, the Defendant got to turn to the left at the direction of the Pungsan mountain.
At the same time, since the left turn is allowed only at a one-lane, the driver who intends to make a left turn at a one-lane shall make a left turn, and the driver shall not turn the left turn at another vehicle which makes a normal left turn normally at a one-lane.
Nevertheless, the Defendant violated the above duty of care by moving to the left at a two-lane and moving to the left normally at a one-lane in the future where it is impossible to identify the number which the Defendant had made a normal left turn.
2. In light of the following circumstances acknowledged by the evidence duly adopted and examined by this court, the evidence alone presented by the prosecutor was left in the future of another vehicle that the defendant gives a normal left-hand turn at the intersection.
The recognition is insufficient, and there is no other evidence to prove it.
A. Article 25(2) of the Road Traffic Act provides that “If the driver of any motor vehicle intends to make a left-hand turn at the intersection, the driver of any motor vehicle shall go slowly along the intersection along the center line of the road in advance and turn to the left at the center of the intersection.”
Therefore, in order for the vehicle that proceeds from the private distance of the Busan Fishery Products Market Center, which is the place of the instant violation of the Road Traffic Act, to the direction of the U.S. village from the remote distance of the relevant large hospital in the East country, to turn to the left, the vehicle is driving along the one lane between the four-lanes of the shooting distance of the East National Hospital in the East National Hospital and turn to the left according to the lane installed inside the intersection at the center of the intersection (at the time, there was an excursion ship with a white line).
