Defendant shall be punished by a fine of KRW 5,000,000.
When the defendant does not pay the above fine, 100,000 won.
Punishment of the crime
The Defendant, who operated C, was awarded a subcontract for D Construction that was ordered by Ansan Construction Co., Ltd.
1. Forgery of private documents;
A. On December 26, 2011, the Defendant drafted an agreement stating that “A Do Construction Co., Ltd. shall subcontract a remodeling work to a member construction company at KRW 14,500,000,000 during D Construction,” using a computer in order to re-subcontract the said construction work at the business site office located in Ansan-si, Ansan-si, Seoul-si, and then arbitrarily affixed his seal impression on the “B” column, stating “A 528-13( Note) of the Gyeonggi-do 528-13(C) of the Ansan-gu, Ansan-gu, Seoul-do, whose representative director was kept in the business site office.”
The Defendant, for the purpose of exercising as above, forged a letter of agreement in the name of the representative director of the Daw Construction Co., Ltd., a private document concerning rights and obligations.
B. On December 31, 2011, the Defendant, at the above D Construction Site Office around December 31, 201, drafted an agreement with the Defendant stating that “In order to re-subcontract the said construction work at the D Construction Site Office, the Defendant shall subcontract the construction work to the City Public Corporation for KRW 22,500,000,00,00 among D Construction Works,” by means of a computer, that “A shall subcontract the construction work to the City Public Corporation for KRW 22,50,000,00,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000 won.”
The Defendant, for the purpose of exercising as above, forged a letter of agreement in the name of the representative director of the Daw Construction Co., Ltd., a private document concerning rights and obligations.
2. Uttering a falsified investigation document;
A. On December 26, 2011, the Defendant committed the crime at the same time and place as Paragraph 1.a. (a) was the document that duly formed the forged agreement.
