1. The Defendant (Counterclaim Plaintiff) against the Plaintiff (Counterclaim Defendant)
(a) Attached Form 1, 2, 3, 11, among the 1st floor of the building listed in Attached Table 1.
A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.
1. Basic facts
A. On February 1, 2018, the Plaintiff entered into a lease contract with respect to the portion (A) of the building (hereinafter “instant building”) attached Table 2, among the 1st floor of the attached Table 1 owned by the Plaintiff, which was connected in sequence with each point of 1, 2, 3, 11, 5, 6, 7, 8, 9, 10, 10 and 1, among the 1st floor of the attached Table 1 attached hereto, and the portion (B) of the building (hereinafter “the instant land”) attached Table 2, among the 3,4,5,11, and 25 square meters of the building (hereinafter “the instant land”), 11 square meters of the land attached to the instant building and the part (b) above, hereinafter “the instant lease object”) under the lease contract with the following period: < Amended by Presidential Decree No. 17200, Feb. 1, 201; Presidential Decree No. 22000, Feb. 1, 2018>
However, at least four times in arrears, the instant lease contract is automatically terminated.
In constructing a temporary warehouse-type building, the lessor shall bear the expenses incurred in installing the building without bearing it.
B. After entering into the instant lease agreement, the Defendant paid the Plaintiff KRW 5,00,000 (hereinafter “the instant lease deposit”), and around February 27, 2018, received the instant building from the Plaintiff, and filed a report on the business of food service business (hereinafter “the instant report”) with the content of the attached Table 3 on the instant building as indicated in the attached Table 3 list, and operated a restaurant selling blades, etc.
C. Since then, the Defendant, among the instant land, installed a warehouse located on the 11m2 adjacent to the instant building (hereinafter “instant warehouse”) on the part (B) part of the instant land connected with each point of 3, 4, 5, 11, and 3 in sequence, which is located within the 11m3m2.
On the other hand, the Chungcheong City Mayor is the building of this case and the land of this case on or around February 13, 2019 on the ground that the warehouse of this case adjoining to the building of this case was extended without permission.
