1. The Defendant’s KRW 40,000,000 as well as the Plaintiff’s annual rate of 5% from March 21, 2016 to September 26, 2017.
Reasons
1. On December 20, 2015, the Plaintiff indicated the claim and lent KRW 40,000,000 to the Defendant on March 20, 2016.
Therefore, the defendant is obligated to pay the above loan and delay damages to the plaintiff from the day following the due date.
2. Grounds for recognition: Articles 208 (3) 3 and 194 of the Civil Procedure Act.
