A defendant shall be punished by imprisonment for a term of one year and three months.
The defendant shall pay 400,000 won to the applicant C, and 450.
Punishment of the crime
On August 12, 2015, the Defendant was sentenced to one year of imprisonment for fraud in the Jinwon District Court's Jinwon District Court's Jinwon Branch's Jinju branch's execution of the sentence was terminated on November 13, 2016.
On September 24, 2017, the Defendant posted a notice to the effect that “H, a website that trades heavy goods, sells air conditioners, TV, etc.” using smartphones at a non-place on September 24, 2017, and then sent the notice to the victim I who reported and contacted the above notice to the effect that “price is deposited first.”

However, since the defendant did not possess the above goods at the time, there was no intention or ability to send the goods even if he receives the price for the goods from the injured party.
As such, the Defendant deceiving the victim and received 500,000 won from the Agricultural Cooperative Account (K) under the name of the Defendant’s mother J on the same day as the price for the goods from the damaged party, and from April 9, 2017, the same year from around the same day.
9. Until December 24, 200, the sum of KRW 9,500,000 was obtained by deceiving 15 times in total from 10 victims, such as the written list of crimes in the attached list of crimes.
On August 30, 2017, the Defendant reported a notice to the “TV and Kimchi air conditioning” located in the mobile fro-market at around 2017, and made a false statement to the Defendant that he would deposit money in advance to the victim L, who called “TV and Kimchi air conditioning”, as well as send money to the Defendant at the cargo stack.
However, even if the defendant receives money from the injured party from the beginning, he did not have the intent and ability to sell the goods.
As such, the Defendant deceivings the victim as such, KRW 70,00,000 at the Nong Bank account (Account Number M) account of the Defendant’s mother J on the same day from the victim, KRW 400,000 at the same account on September 16, 2017, and KRW 300,000 at the same time on October 31, 2017 and November 2, 2017, respectively. < Amended by Act No. 150053, Oct. 31, 2017; Act No. 10052-30, Nov. 9, 2017; Act No. 15095, Nov. 2, 2017>
