On August 31, 2013, at around 20:00 on August 201, the Defendant, as a result of the Defendant’s appearance in the vicinity of the university accompanying the victim C (n, 19 years of age) from the outer third village of the victim C, was drinking together from the “F” main point of “F” in the vicinity of the E University D located in Nam-gu Incheon Metropolitan City.

피고인은 같은 날 22:00경 이미 술에 취해 있던 피해자에게 "우리 집에서 한잔 더 하자"고 말하여 피고인의 주거지인 인천 남구 G 101호로 피해자를 데려가 계속하여 술을 마시던 중, 술에 취한 피해자가 잠이 들자 자신의 옷을 모두 벗고 술에 만취하여 깊이 잠이 든 피해자의 속옷까지 모두 벗긴 뒤 피해자의 몸 위로 올라타 가슴 등 온몸을 입으로 애무하고 손가락을 음부에 삽입하였고, 이상한 느낌에 잠에서 깨어난 피해자가 피해자의 몸 위에 올라탄 상태에서 피해자의 유방을 핥는 피고인을 양손으로 밀어내자 피해자의 손을 뿌리치고 피해자를 누르는 등 반항하지 못하게 한 후 계속하여 피해자의 음부와 유방 등 온몸을 입으로 애무하고, 손으로 음부를 만져 추행하였다.

계속하여 피고인은 2013. 9. 1. 07:00경 잠에서 깨어나, 옆에 잠들어 있는 피해자의 유방과 음부를 손으로 만지고 입으로 빨고 키스를 하였고, 이를 느끼고 잠에서 깨어나 일어나려 하는 피해자를 억지로 눕히고 피해자의 손을 밀치는 등 반항하지 못하게 한 후 입과 손으로 피해자의 유방과 배, 귀를 핥고 음부를 애무하고, 가슴을 깨무는 등 추행하였다.

As a result, the defendant committed indecent acts against the victim who is a relative, and led the victim to a bid on both sides requiring treatment for about seven days.
