The prosecutor's appeal is dismissed.

Reasons

1. In light of the records of the judgment of the court of first instance, the first instance court's decision that acquitted the defendant on each of the facts charged of this case on the grounds as stated in its reasoning is justified, and there is no illegality such as misunderstanding of facts affecting the judgment, and thus, the prosecutor's above assertion of this case cannot be accepted.
