1. The Defendant (Counterclaim Plaintiff) paid KRW 29,474,663 to the Plaintiff (Counterclaim Defendant) and its related amount from April 18, 2014 to December 13, 2017.
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The plaintiff is a company that operates civil engineering construction business, etc., and the defendant is a company that operates welfare facilities for the aged.
B. On April 2, 2012, the Plaintiff entered into a construction contract with the Defendant and the Korea General Welfare Center (hereinafter “the instant building”) on April 2, 2012, with respect to the construction of the “Korea General Welfare Center” on the ground of 727, Gangdong-gu, Gangdong-gu, Seoul (hereinafter “Seoul General Welfare Center”) as the construction cost of KRW 4.277,350,000,000,000 per day), 3/100 of the liquidated damages rate, and September 30, 2012 (hereinafter “instant construction contract”). From February 15, 2013, the defendant operates a medical care center in the building of this case.
C. On November 25, 2013, the Defendant agreed to the following terms: (a) additional agreement; (b) the Defendant entered into an agreement:
