A. On March 17, 2005, Homato Savings Bank Co., Ltd. (formerly: New Mutual Savings Bank: hereinafter “Stoma Savings Bank”) entered into a credit transaction agreement with Defendant A Co., Ltd. (hereinafter “Defendant Company”) within the limit of KRW 4,000,000,000, and Defendant B jointly and severally guaranteed the Defendant Company’s obligations.

B. The Defendant Company lost the benefit of time by delaying the repayment of the above loan, and the remaining debt amount as of June 26, 2014 is the total of KRW 4,00,000,000, interest rate of KRW 4,146,849,312, etc. 8,200,67,530.

C. Meanwhile, on June 28, 2011, the non-party bank transferred all rights including the above loan claims to the Plaintiff, and around that time notified the Defendants of the assignment of claims.

Accordingly, the Plaintiff filed the instant lawsuit with the Defendants in order to be paid KRW 200,000,000 among the principal and interest of the loan and damages for delay.
