The prosecution of this case is dismissed.
Reasons
1. 공소사실 피고인은 2018. 7. 23경 ‘B’라는 이름의 C에서, C 활동으로 알게 된 피해자 D와 위 조합의 시공사 선정문제에 대해 의견이 다르다는 이유로 피해자에게 “개씹팔년아!!!, 병신같은년아, 기생충 벌레같은년”라는 내용의 문자를 보내고 그 문자 내용을 캡쳐하여 불특정 다수가 이용하는 위 C에 위 캡쳐사진을 게시하는 방법으로 공연히 피해자를 모욕하였다.
2. Determination
(a) Matters subject to prosecution upon complaint: Articles 311 and 312 (1) of the Criminal Act;
B. On April 16, 2019, the victim, after the indictment of this case, withdrawn the complaint against the defendant.
(c) Judgment dismissing public prosecution: Article 327 subparagraph 5 of the Criminal Procedure Act;
